General Conditions
(pursuant to Chapter I, Title 3, Part 3 of Legislative Decree 206/2005 and subsequent amendments and additions)
- Introduction and Effectiveness of the General Conditions
These general terms and conditions of sale (hereinafter, “General Conditions”) govern the purchase of products and services made remotely and made available via the internet through the website podereilcasale.com (hereinafter, the “Site”) in compliance with Italian legislation under Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, “Consumer Code”).
The seller of the products and owner of the Site is Podere Il Casale srl, with registered office at Via delle Terme 40, 53045 Montepulciano (SI), VAT & Tax Code: 01587060524 –

The consumer who accesses the Site to make purchases (hereinafter “Customer”) is required to read these General Conditions carefully before submitting an order.
If the person making purchases on the Site requests an invoice and/or is not a “consumer or user” as defined in Article 3, paragraph 1, letter a) of the Consumer Code, the right of withdrawal provided for in Articles 7 and 8 of these General Conditions will not apply, nor, more generally, the provisions that, under the Consumer Code, apply only to “consumers.”
Contracts concluded with Podere Il Casale through the Site are governed by these General Conditions in compliance with Italian law. The language available for concluding the contract is Italian.
- Selection and Ordering of Products
The characteristics and price of the various products on sale on the Site (hereinafter “Product” or “Products”) are indicated on the relevant page for each Product.
To purchase Products, the Customer must complete and submit the order form in electronic format, following the instructions on the Site. The Customer must add the Product to the “Cart” and, after reviewing the General Conditions and Privacy Policy and confirming their acceptance, enter the shipping and billing details, select the desired payment method, and confirm the order.
By submitting the order from the Site, the Customer acknowledges and declares to have read all the information provided during the purchase process and fully accepts these General Conditions and payment terms.
The contract between Podere Il Casale and the Customer is considered concluded upon acceptance of the order by Podere Il Casale. This acceptance is communicated to the Customer via an order confirmation email containing a link to these General Conditions, the order number, shipping and billing details, the list of ordered Products with their essential characteristics, and the total price, including delivery costs. The Customer must check the confirmation email and, if errors are identified in the order, has 12 hours from receipt of this email to contact Podere Il Casale directly from the Site using the contact form accessible via the “https://podereilcasale.com/it/contatti/” tab or by using the email address commerciale@podereilcasale.it. After this period, the order will be processed for shipment, and no further modifications will be accepted, without prejudice to the Customer’s rights under Article 7.
- Product Information
Product information and characteristics are available on the Site along with the corresponding Product codes.
The visual representation of the Products on the Site, where available, usually corresponds to the photographic image accompanying the descriptive sheet. It is understood that the image of the Products is for presentation purposes only and may not be perfectly representative of their characteristics and quality, as it may differ in color and size. In case of discrepancies between the image and the written Product description, the latter shall prevail.
- Prices and Shipping
The product prices include the Value Added Tax (VAT). All prices are expressed in Euro (€).
Shipping within Italy: Shipping is free for orders over €75. For orders below this amount, the shipping cost is from min. €9. If the delivery destination is on an island (Sicily, Sardinia, Tuscan Archipelago, Campanian Archipelago, Phlegraean Islands, Pelagie Islands, Aeolian Islands, Egadi Islands, Maddalena Archipelago, and Venice), a ferry surcharge will be applied even for orders over €75.
International Shipping: Shipping costs range from €14 to €400, depending on the weight and destination country.
- Payment Methods and Invoicing
5.1 Payment Methods
Customers may pay for the Products and related delivery charges via:
– Credit card (Visa / Visa Electron, Mastercard, American Express)
– PayPal
– Bank transfer
– Prepaid cards
To ensure maximum security, the Customer will complete the payment transaction directly on the bank’s secure server.
The Website does not store the Customer’s credit card number. However, thanks to the secure communication system of the relevant financial institution, from the second purchase onwards, the Customer—by selecting the appropriate option—can proceed with the purchase without re-entering their payment details.
The financial institution uses the SSL protocol to encrypt the data transmitted between its server and the Customer’s browser.
PayPal
Once the order is confirmed, the Customer will be redirected to the PayPal website, where they can complete the payment using their PayPal account, a credit or prepaid card, or any other payment method accepted by PayPal, in compliance with its terms and conditions.
Bank Transfer
The Customer must complete the bank transfer within 3 days from the order date. If payment is not received within this period, the order will be canceled, and the products will be made available for purchase by other Customers. The Customer who has not completed the transfer may be contacted by the seller to clarify whether the missed payment was due to the Customer’s decision not to confirm the purchase or other reasons.

Payment reference: The Customer must indicate the order date and order number in the transfer reference, which can be found in the confirmation email (e.g., “Order 01/01/14 No. 100012345”).
5.2 Order Invoicing
If the purchase is made by a professional, an invoice can be requested by selecting the appropriate box during the order process and entering the billing details, including the tax code and/or VAT number. The invoice will be sent via email. The professional is responsible for entering the billing information correctly. If an invoice is not requested at the time of the order, it cannot be requested later.
- Shipping and Delivery
Products purchased on the Website will be delivered to the address provided by the Customer during the purchase process in the designated “Shipping Information” field.
All purchases will be delivered via express courier (hereinafter referred to as the “Courier”) from Monday to Friday, excluding public holidays and national holidays. Podere Il Casale is not responsible for unforeseeable delays or delays beyond its control.
Once the Products have been shipped, the Customer will receive a confirmation email including a link for tracking the shipment.
In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered within 7 (seven) working days from the day following the order confirmation email sent by Podere Il Casale.
International shipments may be handled by different couriers depending on the destination country, ensuring the best available rate for the Customer.
Countries where the service is available: Italy, Europe, United States, Canada, Australia, Hong Kong, Indonesia, Japan, New Zealand, Thailand, Singapore.
- Right of Withdrawal
The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except for the cases of exclusion provided in section IV below. To exercise this right, the Customer must send a communication to Podere Il Casale within 14 days from the date of receipt of the Products using the form available for download here. If the Customer wishes to exercise the right of withdrawal before receiving the Products, the withdrawal notice may be sent at any time before their receipt.

Once the communication has been received, Podere Il Casale will provide the Customer with instructions on how to return the Products.
The right of withdrawal is governed by the following conditions:
The right applies to the purchased Product in its entirety; therefore, if the Product consists of multiple components or parts, it is not possible to exercise withdrawal only on part of the purchased Product.
In the event of exercising the right of withdrawal, Podere Il Casale will refund the Customer the full amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the withdrawal notice was received, while reserving the right to withhold reimbursement until actual receipt of the goods. The refund will be made using the same payment method used by the Customer unless the Customer has expressly requested a different method. In the case of a bank transfer or cash-on-delivery payment, the Customer must provide the bank details necessary for the refund (account holder, bank name and address, and IBAN).
To ensure free returns as per Article 8 below, the Products must be returned in the same packaging in which they were received.
In addition to the cases mentioned in the introduction (non-consumer customers and/or those requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to Article 59 of Legislative Decree 21/2014:
– Orders of Products made to measure or clearly personalized;
– Orders of Products that may deteriorate or expire rapidly;
– Orders of sealed Products that are not suitable for return due to hygiene or health protection reasons or that have been opened after delivery.
In cases where the right of withdrawal is excluded, Podere Il Casale will return the purchased Products to the Customer, charging the shipping costs to the latter.
- Free Return in Case of Withdrawal
Podere Il Casale fully covers the shipping costs for the return of Products in the event of exercising the right of withdrawal.
To benefit from free shipping, the Customer who wishes to exercise the right of withdrawal must follow the procedure indicated in Article 7 and wait to be contacted by Podere Il Casale to arrange the return of the Products to the courier.
- Order Cancellation or Change of Shipping Address
The Customer may cancel or request a change of the order’s shipping address within 12 hours of placing the order. After this period, the order will be processed, and it will no longer be possible to request cancellation or a change of shipping address.
The Customer must contact the seller directly through the Website using the dedicated contact form accessible via the footer under “Contacts.”
Podere Il Casale reserves the right to cancel the order in case of unforeseen difficulties, informing the Customer via email, or, upon agreement, modifying the delivery date and/or time.
- Warranty and Lack of Conformity
In case of lack of conformity of the Products sold by Podere Il Casale, the Customer must immediately contact the seller using the appropriate contact form available on the Website via the “https://podereilcasale.com/it/contatti/“.
The legal warranties provided by Articles 129, 130, and 132 of the Consumer Code apply to the sale of the Products. The Customer is entitled, at their choice and provided that the type of Product allows it, to the restoration of the Product’s conformity at no cost through repair or replacement, or to an appropriate price reduction or contract termination.
In the case of wine with defects or alterations, the Customer is required to keep the bottle with at least 2/3 of its contents and its original cork and to report the presumed non-conformity to the seller.
Podere Il Casale will intervene as soon as possible by arranging a free collection to conduct a thorough inspection and propose the most suitable solution.
The Customer loses these rights if they do not report the lack of conformity to Podere Il Casale within two months from the date they discovered the defect, unless the Product is perishable or has an expiration date within a shorter period, in which case the defect must be reported within that reduced timeframe.
- Errors and Limitations of Liability
The information regarding the Products provided through the Website is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which Podere Il Casale cannot be held responsible, except in cases of willful misconduct or gross negligence.
Podere Il Casale reserves the right to correct errors, inaccuracies, or omissions even after an order has been placed, as well as to modify or update information at any time without prior notice, without prejudice to the Customer’s rights under these General Terms and the Consumer Code.
Except in cases of willful misconduct or gross negligence, any right of the Customer to claim damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance or partial fulfillment of an order.
Podere Il Casale promotes the responsible consumption of alcohol and excludes any liability, except in cases of willful misconduct or gross negligence, in the event of a purchase made by individuals under the age of 16.
By purchasing any alcoholic product, you declare that you are of legal age as required by Article 7 of Legislative Decree 158/2012.
Podere Il Casale assumes no responsibility in the case of a purchase made by individuals under the age of 18 who have falsely declared their age.
- Complaints
Any complaints must be submitted to Podere Il Casale using the appropriate contact form available directly on the Website via the “https://podereilcasale.com/it/contatti/” tab, or by calling the phone number 0578755109 (from abroad: +39 0578755109), available Monday to Friday from 9:00 AM to 5:00 PM, excluding public holidays, or by registered mail with return receipt to the following address:

Podere Il Casale commits to responding to all requests within a maximum of 7 working days.
- Applicable Law and Jurisdiction
The sales contract between the Customer and Podere Il Casale is deemed to be concluded in Italy and governed by Italian law.
For disputes concerning the interpretation, execution, or termination of these General Terms or individual purchase orders, if the Customer is a consumer under the Consumer Code, the exclusive jurisdiction will be that of the court of their place of residence or domicile, provided it is within Italian territory.
In all other cases, the exclusive jurisdiction will be that of the Court of Siena, with any other jurisdiction expressly excluded.
Pursuant to Article 1341 of the Italian Civil Code, the Customer declares to have read and specifically accepted the following articles of these General Terms and Conditions: 6 (liability for delivery delays), 10 (right to correct errors – exclusions of liability).
